            Ref.: Sending the letter received by the Romanian authorities on the rules on compulsory motor third party liability insurance

 

            Dear Mr. Vice-President,

 

            The National Union of Road Hauliers from Romania - UNTRR is requesting the letter you sent to the Romanian authorities on July 19, 2018, about an eventual infringement regarding motor third party liability (MTPL) insurance legislation.

            In this letter, the European Commission is requesting the Romanian authorities to submit a series of comments on current national legislation on MTPL. In order to substantiate its position, the Financial Supervisory Authority (ASF) asked for an opinion from the road hauliers on possible changes in the legislation. In this regard, UNTRR asks for the letter sent to the Romanian authorities in order to be able to submit our observations.

            We would like to point out that recently, in the period 2014 - 2016, the Romanian road transport industry faced alarming situation due to exaggerated and unjustified increase of Motor Third Party Liability (MTPL) Insurance premiums for road transport companies, leading to significant increase of their costs and affecting their competitiveness.

            The new legislation, Law 132/2017 had decisive positive effects in the market, as the current MTPL rates applied by insurers are below the reference price, and no company selling MTPL insurance before the capping of the tariffs and adopting Law 132/2017 did not withdraw market.
